Crackbook plate intends to be a platform for the aspiring users to constructively use it to discuss, share and socialize with others their problems and opinions. To be useful, it requires a responsible use and gives the users certain rights along with few responsibilities. Please read carefully the following major terms and conditions and the statement of rights and responsibilities:

1. Though Crackbook plate encourages constructive criticism or encouragement of any commercial organization, institution or entity for non-commercial purposes by a user, Crackbook plate shall not be used for unwarranted commercial favors or disfavors to any particular commercial organization, institution or entity. In simple words, user may criticize or praise a commercial organization, institution or entity constructively and not just for the sake of it.
2. Use of indecent photographs as profile pictures or otherwise and use of indecent language for comments/ discussions or otherwise against any entity or person or otherwise is strictly prohibited and punishable under various Indian laws and acts. Use of such indecent content may lead to permanent deletion of user account and blacklisting of user by Crackbook.
3. Crackbook users shall be subject to new terms and conditions established by Crackbook plate as applicable from time to time.

Statement of Rights and Responsibilities
User owns all of the content and information he/ she posts on Crackbook and is solely responsible for all the issues (of any kind) related to it. For content that is covered by intellectual property rights (IPRs), like photos and videos or anything else, user is solely responsible for all the legal or other issues related to it. Crackbook shall not be held responsible for any kind of complications involved in posting of such content.
When user deletes any sort of content including IP content, it is deleted in a manner similar to emptying the recycle bin on a computer. However, user understands that removed content may persist in backup copies for a reasonable period of time (but will not be available to others). The deleted content may be stored by other users in their computers or in the printed hard copies taken out before such deletion. Crackbook shall not be responsible for such kind of downloads or print-outs by other users and the user who posted such contents shall be solely responsible for it.
User understands that the content posted on the crackbook remains in the public domain accessible to all whether a visitor is a registered user of Crackbook or not. When a user publishes content or information over the Crackbook, it means that he/she is allowing everyone, including people off of Crackbook, to access and use that information, and to associate it with you (i.e., your name and profile picture).
We always appreciate your feedback or other suggestions about Crackbook, but the user understands that we may use them without any obligation to compensate you for them (just as you have no obligation to offer them). Further we may use this feedback along with your name and profile picture as a testimonial to Crackbook.
We do our best to keep Crackbook safe, but we cannot guarantee it. We need your help to keep Crackbook safe, which includes the following commitments by you:
  A.  User will not post unauthorized commercial communications (such as spam) on Crackbook.
  B.  User will not collect other users' content or information, or otherwise access Crackbook, using automated means (such as harvesting bots, robots, spiders, or scrapers) without our prior permission.
  C.  User will not engage in unlawful multi-level marketing, such as a pyramid scheme, on Crackbook.
  D.  User will not upload viruses or other malicious code.
  E.  User will not solicit login information or access an account belonging to someone else.
  F.  User will not bully, intimidate, or harass any other user.
  G.  User will not post content that: is hate speech, threatening, or pornographic; incites violence; or contains nudity or graphic or gratuitous violence.
  H.  User will not develop or operate a third-party application containing alcohol-related, dating or other mature content (including advertisements).
  I.   User will not use Crackbook to do anything unlawful, misleading, malicious, or discriminatory.
  J.   User will not do anything that could disable, overburden, or impair the proper working or appearance of Crackbook, such as a denial of service attack or interference with page rendering or other Crackbook functionality.
  K.  User will not facilitate or encourage any violations of this Statement or our policies.
Crackbook users provide their real names and information, and we need your help to keep it that way. Here are some commitments you make to us relating to registering and maintaining the security of your account:
  A.  User will not provide any false personal information on Crackbook, or create an account for anyone other than his own without permission.
  B.  User will not create more than one personal account.
  C.  If we disable user's account, he will not create another one without our permission.
  D.  User will not use his personal timeline for his own commercial gain (such as selling his status update to an advertiser).
  E.  User will not use Crackbook if he is under 13.
  F.  User will not use Crackbook if he/she is a convicted sex offender.
  G.  User will keep his contact information accurate and up-to-date.
  H.  User will not share his password, let anyone else access his account, or do anything else that might jeopardize the security of his account.
  I.   User will not transfer his account to anyone without first getting our written permission.
  J.  If user selects a username or similar identifier for his account, we reserve the right to remove or reclaim it if we believe it is appropriate (such as when a trademark owner complains about a username that does not closely relate to a user's actual name).
Protecting Other People's Rights
  A.  We respect other people's rights, and expect the user to do the same. User will not post content or take any action on Crackbook that infringes or violates someone else's rights or otherwise violates the law.
  B.  We can remove any content or information user posts on Crackbook if we believe that it violates this Statement or our policies.
  C.  If we remove user's content for infringing someone else's copyright, and user believes we removed it by mistake, we will provide you with an opportunity to appeal.
  D.  If user repeatedly infringes other people's intellectual property rights, we will disable user's account when appropriate.
  E.  User will not use our copyrights or trademarks (including Crackbook and Logos), or any confusingly similar marks.
  F.  User will not post anyone's identification documents or sensitive financial information on Crackbook.
If user violates the letter or spirit of this Statement, or otherwise create risk or possible legal exposure for us, we can stop providing all or part of Crackbook to the user. You may also delete your account at any time by sending us a mail.
User will resolve any claim, cause of action or dispute (claim) the user have with us arising out of or relating to this Statement or Crackbook exclusively in the courts located in the state of Punjab (India). The laws applicable in the territory of India will govern this Statement, as well as any claim that might arise between the user and us. User agrees to submit to the personal jurisdiction of the courts located in the state of Punjab for the purpose of litigating all such claims.
If anyone brings a claim against us related to a user's actions, content or information on Crackbook, the user will indemnify and hold us harmless from and against all damages, losses, and expenses of any kind (including reasonable legal fees and costs) related to such claim. Although we provide rules for user conduct, we do not control or direct users' actions on Crackbook and are not responsible for the content or information users transmit or share on Crackbook. We are not responsible for any offensive, inappropriate, obscene, unlawful or otherwise objectionable content or information user may encounter on Crackbook. We are not responsible for the conduct, whether online or offline, or any user of Crackbook.
WE TRY TO KEEP Crackbook UP, BUG-FREE, AND SAFE, BUT user USEs IT AT his/her OWN RISK. WE ARE PROVIDING Crackbook AS IS WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT Crackbook WILL ALWAYS BE SAFE, SECURE OR ERROR-FREE OR THAT Crackbook WILL ALWAYS FUNCTION WITHOUT DISRUPTIONS, DELAYS OR IMPERFECTIONS. Crackbook IS NOT RESPONSIBLE FOR THE ACTIONS, CONTENT, INFORMATION, OR DATA OF THIRD PARTIES, AND YOU RELEASE US, OUR DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS FROM ANY CLAIMS AND DAMAGES, KNOWN AND UNKNOWN, ARISING OUT OF OR IN ANY WAY CONNECTED WITH ANY CLAIM user HAVE AGAINST ANY SUCH THIRD PARTIES. WE WILL NOT BE LIABLE TO user FOR ANY LOST PROFITS OR OTHER CONSEQUENTIAL, SPECIAL, INDIRECT, OR INCIDENTAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THIS STATEMENT OR Crackbook, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY ARISING OUT OF THIS STATEMENT OR Crackbook WILL NOT EXCEED THE GREATER OF ONE HUNDRED RUPEES.

Definitions

  A. By "Crackbook" we mean the features and services we make available, including through (a) our website at www.crackbook.in; (b) our Platform; (c) social plugins such as the Like button, and other similar offerings and (d) other media, software (such as a toolbar), devices, or networks now existing or later developed.
  B. By "Platform" we mean a set of APIs and services (such as content) that enable others, to retrieve data from Crackbook or provide data to us.
  C. By "information" we mean facts and other information about you, including actions taken by users and non-users who interact with Crackbook.
  D. By "content" we mean anything you or other users post on Crackbook that would not be included in the definition of information.
  E. By "data" or "user data" or "user's data" we mean any data, including a user's content or information that user or third parties can retrieve from Crackbook or provide to Crackbook through Platform.
  F. By "post" we mean post on Crackbook or otherwise make available by using Crackbook.
  G. By "use" we mean use, copy, publicly perform or display, distribute, modify, translate, and create derivative works of.
  H. By "active registered user" we mean a user who has logged into Crackbook at least once in the previous 30 days.
  I. By "application" we mean any application or website that uses or accesses Platform, as well as anything else that receives or has received data from us. If you no longer access Platform but have not deleted all data from us, the term application will apply until you delete the data.

Other
  A.  This Statement makes up the entire agreement between the parties regarding Crackbook, and supersedes any prior agreements.
  B.  If any portion of this Statement is found to be unenforceable, the remaining portion will remain in full force and effect.
  C.  If we fail to enforce any of this Statement, it will not be considered a waiver.
  D.  Any amendment to or waiver of this Statement must be made in writing and signed by us.
  E.  User will not transfer any of his rights or obligations under this Statement to anyone else without our consent.
  F.  All of our rights and obligations under this Statement are freely assignable by us in connection with a merger, acquisition, or sale of assets, or by operation of law or otherwise.
  G.  Nothing in this Statement shall prevent us from complying with the law.
  H.  This Statement does not confer any third party beneficiary rights.
  I.  We reserve all rights not expressly granted to user.
  J.  User will comply with all applicable laws when using or accessing Crackbook.
